In many cases, countries applying an economic employer concept have the power of taxation under tax treaties on remuneration covered by the new proposal. The OECD's concept of the "economic employer" plays an important role in this context, as it indicates that the "employer" of a globally mobile employee may not necessarily be the legal employer. Many tax authorities have adopted an "economic employer" approach to interpreting Article 15* of the OECD model tax treaty, which deals with employment and dependent services. After discussions that began in 2017, last month Sweden’s parliament approved the introduction of the Economic Employer Concept in Sweden, and new regulations came in to force on January 1 2021. The new legislation will focus on foreign employers as well as the tax liability of foreign employees operating within Sweden.
As a consequence more foreign workers and business travellers, working temporarily in Sweden, will be subject to Swedish tax on salary income. According to the Tax Agency’s proposal, the “economic employer” concept should also be introduced in Sweden in connection with the application of the 183-day rule. An employee who is employed by a foreign company with no permanent establishment in Sweden should therefore be taxed here when they have performed their services on behalf of a Swedish business, company or other type of organisation.
